Small Estate Trust
Perfect for smaller estates, this Small Estate Trust helps avoid probate without the complexities of tax planning. Ideal for both married and unmarried individuals, this is one of our most requested trust types in California.
Disclaimer Trust (Most Common)
For married couples with estates that may or may not exceed the federal tax exemption amount when the first spouse dies. It gives the surviving spouse the option to create the Bypass Trust if it is economically advantageous to do so; but does not require it if there is no tax advantage.
Exemption Trust
For marriedcouples with estates that do, or are likely to exceed the federal exemption amount when the first spouse dies, or for families with smaller estates who want to divide the estate into two trusts at the death of the first spouse for distribution purposes. This Trust mandates the creation of a Bypass Trust and has beneficial tax advantages for the beneficiaries.
QTIP Trust
For couples with estates over the federal tax exemption amount. At the first death, the estate is divided into three Trusts, and takes full advantage of the marital tax deduction. It also ensures the “deceased spouse’s” greater control over the distribution of his or her share of the trust assets.
Special Needs Trust
If a beneficiary has special needs that qualify for government support, a Special Needs Trust provision can be built into a revocable trust. It is funded when normal distribution takes place, and allows for a trustee to manage the estate of the beneficiary.
